Terms and Conditions

1. definitions

1.1 In these General Terms and Conditions, the following terms (both singular and plural) have the following meanings:

  • ‘General Terms and Conditions’, the General Terms and Conditions of Explore Pass;
  • ‘Attraction’, touristic place of interest; the public or private event at which – by way of example, but not exclusively – an activity of a tourist nature takes place;
  • ‘Location’, the place at which the attraction is held;
  • ‘Organiser’, the party responsible for the production and/or organisation of the attraction;
  • ‘Agreement’, the agreement between Explore Pass and the consumer for the sale and delivery of tickets;
  • ‘Ticket’, proof of access to an attraction.

2. Applicability 

2.1 The General Terms and Conditions below and the booking and ordering conditions of Explore Pass apply to all offers, orders and agreements of Explore Pass.

2.2 In addition, the General Terms and Conditions of the organiser and the General Terms and Conditions of the party responsible for the locations will also apply to the agreement. In the event of any conflict between the provisions in the agreement or in these General Terms and Conditions and the aforementioned terms and conditions, the provisions in the agreement or in these General Terms and Conditions will prevail. Copies of the General Terms and Conditions of the parties responsible for the Locations or of the organiser are available on request from the parties responsible for the locations in question or from the organiser.

2.3 By making an order, the consumer expressly accepts the applicability of these General Terms and Conditions.

2.4 Deviations from that stipulated in these Terms and Conditions are only possible in writing, in which case the other provisions will remain undiminished in force.

2.5. All rights and entitlements stipulated for Explore Pass in these General Terms and Conditions and any further agreements will also apply for intermediaries and other third parties deployed by Explore Pass.

3. Prices/offers

3.1 All offers made by Explore Pass are without obligation and Explore Pass expressly reserves the right to change the prices, in particular if this is necessary as a result of statutory or other regulations.

3.2 All prices are indicated in euros, including VAT.

3.3 In certain cases, promotional prices apply. These prices are valid during a specific period as long as stocks last. No entitlement to these prices may be invoked before or after the specific period.

3.4 Explore Pass cannot be held to any price indications that are clearly incorrect, for example as a result of obvious typesetting or printing errors. No rights may be derived from incorrect price information.

4. Cancellations and returns

4.1 Purchased passes can be used straight away and are valid for one year from purchase.

4.2 You may cancel a pass at any time within 14 days of the date of purchase.

4.2.1 If you cancel within the period specified above, Explore Pass shall refund any payment you may have made for the period cancelled. If you cancel later, you are not entitled to any refund of money paid.

4.2.2 To cancel, you must contact Explore Pass within 14 days of your purchase date. Explore Pass will reimburse your cancellation.

4.1.3 In order to process your cancellation, we will need you to supply us with the following details to hello@explore-pass.com:

  • Order number
  • Purchase Date
  • Name and Address of Customer
  • Email Address of Customer
  • Date of cancellation

4.1.4. You do not have the right to cancel your order for the Pass within the 14-day cancelation period if you have started using your pass.

4.1.5. The confirmation of cancellation that we send to you is your proof of cancellation and should be retained by you. No duplicate Booking or passes will be issued to replace the original that have been lost or stolen after it has been emailed to you, and nor will price of such Booking be refunded.

4.2 All purchased tickets to attractions through your Explore Pass are final. Cancellation for entrance tickets is not possible. 

4.2.1 Unused Explore Points can not be exchanged for money or other products.

4.3 An organiser is entitled to cancel or change the date of an event. Should this happen, Explore Pass will attempt to provide a suitable solution. If an event is canceled or postponed, Explore Pass will do its utmost to inform you as soon as possible. However, Explore Pass cannot guarantee it is possible to inform you timely of any change or cancellation of an event or be held responsible for refunds, compensations or for any resulting costs you may incur, for example for travel, accommodation and/or any other related goods or service.

4.4 Before confirming your booking, always check carefully that you have booked the correct (number of) tickets. Some of the tickets we offer for a product with a specific date and time (‘timed entry tickets’) are not refundable.

4.5 Explore Pass shall not be liable for damage, misuse, or loss of tickets. No duplicate tickets will be issued to replace tickets that have been misused, mistreated, lost, or stolen, and nor will such tickets be refunded.

4.6 Explore Pass shall not be liable for delays, non-delivery or incorrect delivery of tickets, if such delay, non-delivery or incorrect delivery cannot be attributed to Explore Pass.

The confirmation of cancellation that we send to you is your proof of cancellation and should be retained by you. No duplicate Passes will be issued to replace the original that have been lost or stolen after it has been delivered to you, and nor will price of such purchase be refunded.

4.7 Not using one or more pre-purchased tickets is for your own account and risk; this is also the case if the admission ticket is only valid for a certain time and/or date.

4.8 The passes are valid for 1 year (12 months), starting from the day you activate your pass in the app.

5. Attractions

5.1 All attractions listed on this website offer free access to Explore Pass holders in exchange for the required Explorer Points listed.

5.2 Explorer Points are redeemed for attraction tickets. By redeeming the required Explore Points you purchase a timed-ticket that will appear in your Explore Pass Wallet. This is your official ticket to gain access to the attraction.

5.3 Redeemed Explorer Points are non-transferable and non-refundable.

5.4 Rescheduling timeslot tickets is possible by contacting the organiser. All organisers are subjected to their own terms and conditions. Explore Pass cannot be held accountable for the conditions of which the organiser hold their services.

5.5 Opening times of locations will fluctuate from time to time and users of information on this website are recommended to check with the organiser before visiting the attraction to ascertain the current operating hours.

5.6 Explore Pass has taken all reasonable care to ensure that only properly run and reputable attractions of good standing are within the Explore Pass options. However, Explore Pass is not liable for any deficiencies in service, quality, health and safety obtaining at any particular attraction.

5.7 Holders of Explore Pass recognize and accept that they visit any attraction voluntarily and entirely at their own risk. Explore Pass is not in any way responsible for the conditions of the attractions or venues or third party acts or omissions at any attraction, venue or service.

5.8 During times of maintenance, temporary exhibitions and special events at the attractions, it is possible that it may not be accessible. This inaccessibility does not entitle the pass holder to a full or partial refund on the Explore Pass. It is the responsibility of the pass holder to confirm with the attraction if it will be open during their time of visit.

5.9 Entry to the location of an organiser is always subject to any terms and conditions or rules of the organiser. If you breach those terms and conditions or rules, then the organiser may refuse your entry or require you to leave the venue.

5.10  The content on the Explore Pass website relating to any attraction has been provided by the organisers. Explore Pass is not responsible for the accuracy of any claim or advertisement.

6. Payments

Explore Pass accepts a number of different payment methods. Payments in euros are processed via iDEAL or by credit card. You will not receive confirmation of your definitive booking until your payment has been approved.

7. Delivery

7.1 You will find the login credentials needed to use the Explore Pass in the email address that you have submitted while making the order.

7.2 The delivery times on tickets for attractions are for indication purposes only. Failure to meet any delivery deadline will not entitle you to damage compensation, nor will it entitle you to cancel the order or dissolve the agreement, unless such failure to meet the delivery deadline is so severe that it cannot reasonably be demanded of you to abide by the agreement. In that case, you will be entitled to cancel the order or dissolve the agreement insofar as this is necessary.

8. Retention of title

The ownership of the tickets delivered will only transfer to you if you have met all your obligations to Explore Pass pursuant to any agreement whatsoever. The risk relating to the tickets will be transferred to you at the time of delivery.

9. Complaints and liability

To issue a complaint about an attraction, please contact the organiser, as Explore Pass is not accountable for the execution.

10. Electronic communication and evidence

10.1 Explore Pass is not liable for any misunderstandings, distortions, delays or incorrect transmission of data and messages as a result of the use of the internet or any other communication resource in the traffic between the customer and Explore Pass (or the parties deployed by the customer).

10.2 The records of Explore Pass will serve as full evidence of the existence, the content and the implementation of the agreement with the customer in any legal procedure, subject to counter-evidence provided by the party that invokes the fact that the evidence is unreliable.

11. Force majeure

11.1 Without prejudice to the other rights to which it may be entitled, in the event of force majeure, Explore Pass is entitled, at its own choice, to suspend implementation of your order or to dissolve the agreement without legal intervention, by informing you of this in writing and without Explore Pass being held liable to any damage compensation unless in the prevailing circumstances this would be unacceptable in accordance with all reasonableness and fairness.

11.2 Force majeure is deemed to mean any shortcoming which cannot be attributed to Explore Pass because it cannot be blamed on it nor deemed to be its responsibility in accordance with the law, legal action or generally accepted views.

12. Special provisions, liability

12.1. The purchaser of a ticket supplied by Explore Pass must behave as a good and orderly visitor of attractions and must abide by the instructions issued to him or her by or on behalf of the organiser of the attraction to be visited as well as by the competent authorities.

12.2 Explore Pass will not be liable for any refusal by the organiser of an attraction or by the public authorities to admit the purchaser of a ticket supplied by Explore Pass to an attraction as a result of actions and/or negligence on the part of the purchaser. 

12.3 The purchaser of a ticket attends an attraction at his or her own risk. Explore Pass will not be liable for any damage incurred by the purchaser during the journey to from the attraction or while attending the attraction.

12.4 The purchaser of a ticket supplied by Explore Pass must inform him or herself of the instructions issued by or on behalf of the organiser of the attraction or the competent authorities relating to it, including any changes concerning the attraction, such as starting time, etc. Explore Pass has no obligation to provide the purchaser of a ticket with further information in this regard.

13. Other provisions

13.1 If one or more of the provisions in these Terms and Conditions or any other agreement with Explore Pass are in conflict with any applicable legal regulation, the provision in question will lapse and be replaced by a new comparable stipulation admissible by law to be determined by Explore Pass.

13.2 The law of the Netherlands applies to all agreements entered into with or concluded by Explore Pass. Any disputes arising directly or indirectly from these agreements will be exclusively settled by the Court of Amsterdam.
